Who Can Apply for a Trademark?
Trademark registration is not restricted only to large corporations. Individuals, startups, NGOs, schools, societies, private limited companies, LLPs, partnerships and even proprietors can register their brand. Even if a business has not started operations yet, an individual can register a brand name to secure ownership for future use.
Documents Required for Trademark Registration
To apply for a trademark in India, the following documents are typically required:

Trademark Classes and Types of Marks
Trademark protection is divided into 45 classes. Class 1–34 cover goods, and Class 35–45 cover services. Choosing the correct class is very important because your mark will be protected only within the registered categories. Businesses can apply in multiple classes if required.

Trademark Registration Process in India
The registration process includes these key stages:

Trademark Search:
A search is conducted to confirm that the proposed mark is not already registered or too similar to an existing brand. -
Filing the Application:
Once the mark is confirmed, the application is filed with the Trademark Registry either online or at the regional office. -
Examination:
The trademark office reviews the application for any objections. If an objection arises, the applicant is allowed to file a reply and appear for a hearing if needed. -
Publication:
After approval, the trademark is published in the Trademark Journal for public review. Anyone can oppose the registration at this stage. -
Registration:
If no opposition is filed or the applicant successfully defends against objections, the trademark is registered and the certificate is issued.
The entire process can take 12–24 months, depending on objections and processing time. However, once the application is filed, the applicant can start using the ™ symbol immediately. After the certificate is issued, the ® symbol can be used.
Renewal and Validity
A trademark is valid for 10 years from the date of registration and can be renewed indefinitely. Missing the renewal deadline can result in cancellation, which means the brand may lose protection and someone else may claim the name.

If someone uses a registered trademark without permission, the owner can send a legal notice, file a lawsuit or claim damages.
