Patent Registration Process in India

Step 1: Conduct a Patent Search

A patent search ensures your invention is unique and not already patented. This step prevents future legal disputes and saves time and resources.

How to Conduct a Patent Search?

  • Use patent databases like IP India, WIPO, and USPTO

  • Analyze existing patents for similarities

  • Consult a professional for an in-depth search

Step 2: Prepare the Patent Application

Once the uniqueness of your invention is established, the next step is drafting a detailed patent application.

Types of Patent Applications

  • Provisional Application – Filed if the invention is in progress; secures an early priority date.

  • Complete Specification – Includes full details of the invention; required for final submission.

Required Documents

  • Patent application form

  • Detailed description with technical drawings

  • Inventor’s information and declaration

  • Patent claims defining scope of protection

Step 3: File the Patent Application

The application is submitted to the Indian Patent Office.

Filing Methods

  • Ordinary Application – For inventions developed entirely in India.

  • Convention Application – Filed within 12 months of an international patent application.

  • PCT International Application – Single filing for multiple countries.

  • PCT National Phase Application – Entering the Indian patent system after a prior PCT filing.

Step 4: Publication of the Patent Application

The patent application is automatically published in the Patent Journal after 18 months. Applicants can request early publication for faster processing.

Step 5: Patent Examination

A Request for Examination (RFE) must be filed within 48 months of the priority date. The examiner reviews the patent’s uniqueness and commercial viability.

Examination Process

  • The examiner issues a First Examination Report (FER) detailing objections, if any.

  • The applicant must respond within 6 months to resolve issues.

Step 6: Opposition and Grant of Patent

After examination, the application may face opposition from third parties.

Types of Opposition

  • Pre-Grant Opposition – Filed before the patent is granted.

  • Post-Grant Opposition – Filed within 12 months after the patent is granted.

If no valid opposition exists, the patent is granted and published in the Patent Gazette.

Step 7: Patent Renewal & Maintenance

A patent remains valid for 20 years from the filing date. To maintain it:

  • Renewal fees must be paid from the 3rd year onward.

  • If not renewed, the patent expires and enters the public domain.
