Designs are again the efforts of the creator and every business person or performer would like to save his or her endeavor. Design Registration is completely different from the patent registration. It is not an alternative or patents but is supplement protection. The advantages of getting registration are:

• It is cheaper than patent registration
• The application is far shorter.
• Infringer may be punished in case of copying
• It is useful in case of the short life of products or easily producible products.
• No one can use or misuse the design without permission

If registration protects of being misused, but it indulges some limitation as well like-

• It protects the pattern or features which are in normal use not the method of operation
• Anyone can have the same or similar functions of products, as it just prevents others to apply the same design features.
• The design may be used by any competitor with some of the modification.

The design registration is valid up to 10 years though it can be extended further for next 5 years. Thus the total time period counts to be 15 years as a whole.

It is not a guarantee of registration as high court or controller of patents may cancel the registration on the following grounds-

• If a design is registered previously
• It has been already published in India
• It is not new or original

Only unique or self-prepared design is accepted for registration

Design registration does not fall on complicated grounds, it is as simple to register the design if it is new, original and unique. Any person, who claims to be the owner or creator of the design, citizen in India, may apply for the registration of design for the unique and real thing which was not previously published anywhere. If you application fulfills the criteria of application of the Designs Act and the Rules, the Controller will provide registration of designs. Patent Office at Calcutta registers the designs. 

To get the legal authentication one need to submit the relevant documents fulfilling the criteria of design registration:-

• Name, address, Age, nationality proof of applicant.
• 10 Numbers of Prints or photographs of designs with several sides which may clearly reveal the clear shape, size, and configuration
• Written proof of priority, if any
• Duly signed power of attorney by Proprietor, partner, one of the directors of the company
• Name, address, designation, and nationality of the signature authorities of General Power of Attorney.
• Copy of MOU & AOU or copy of partnership deed 

Note : The English language is preferred for submission of the above-mentioned documents.
What are the rights obtained by registration of Designs?

Being the owner of design he has the exclusive rights to the designs and its usage. He may apply the design to any article for which category it is being registered.
